
The US Senate has passed the “Fairness for High Skilled Immigrants Act, 2019” by a resounding majority of 365 to 65 votes. The new Act does away with the 7% country cap on issuance of Green Cards. This has certainly brightened the prospects for many Indian techies who wish to migrate to the US as it increases their possibility of getting a Green Card.
Many Indian techies have been in the queue for a Green Card
for over a decade. Due to the previous country cap, the current wait time for
some of them was as high as 70 years. But with the new Fairness for High
Skilled Immigrants Act, 2019, all this should be a thing of the past.
Mr Xavier Augustin,
Founder and CEO of Y-Axis said that the US is opening its doors to more Indian
professionals especially tech experts. The H1B Visa approval will lead them
directly to obtaining a Green Card in the US. The passing of this Act shows how
much the US depends on Indian techies and wants them to stay back.
Mr Augustin further added that the US would like more
technical experts to come to the country. This will bring back the popularity
of the H1B Visa. Also, pending technical category applications for the Green
Card will all now go to Indians. He believes that the process would be
transitioned smoothly.
The Fairness for High Skilled Immigrants Act will increase
the country cap for family-based immigrant visas from 7% to 15%.
The Act will also
eliminate the country cap on employment-based immigrant visas.
Previously, while applying for a Green Card, every member of
a family was counted. So sometimes, when a family of 4 applied for a Green
Card, the US would grant it to the parents and 1 child. However, now the entire family will be regarded as one unit, as per

The new Bill was championed by Sunayna Dumala, wife of Indian Engineer Shrinivas Kuchibhotla who was killed in a hate-crime shootout in
the US. She says that it is a monumental day; one that she has been waiting for
years. She says, that all her hard work and efforts have finally borne fruit.
