
July 10, 2019, holds a special significance for Indian professionals thinking of migrating to the U.S.
It was on this
day that the U.S. House of Representatives gave the nod to the Fairness for
High-Skilled Immigrants Act of 2019.
The bill was
passed with an impressive majority of votes. While 65 voted against, 365 voted
in favour.
An applicant’s
country of birth will no longer determine the applicant’s access to
employment-based green cards.
Amending the
Immigration and Nationality Act, the Fairness for High-Skilled Immigrants Act –
§ Eliminates
the “numerical limitation” or per-country capping on employment-based
immigrants
§ Increases the
capping, per-country, for the immigrants that are sponsored by the family
§ For other
purposes
The Fairness for
High-Skilled Immigrants Act holds much promise for Indian professionals.
Removing the per-country cap for green cards, the Act will reduce the existing
backlog.
Shorter waiting
time for getting Legal Permanent Resident status will be an incentive for many
from China, the Philippines, and India to go in for employment-based PR status.
As of now, a
country is limited to a 7% share of the total green cards to be issued to
foreign workers in a fiscal year.
Removing the
numerical limitation based on the country of birth, the Act aims at allowing talented
professionals to gain visas irrespective of their origins.
Even so, there
is a good reason to hold back the celebration as of now.
The Fairness for
High-Skilled Immigrants Act still has to be passed by the Senate as well.
Following which, for the Act to be considered a law, it will have to be
signed by President Trump.
There is indeed
much to rejoice if the Fairness for High-Skilled Immigrants Act becomes the
law. Indians facing the present immense backlog of green cards will then be
sharing the backlog with other countries as well.
